Welcome to YourSewickley.com, a service of the Sewickley Herald, PittsburghLIVE.com and the Tribune-Review Publishing Co. By using this site, you agree to the terms of this Community Agreement and to the Tribune-Review Publishing Co. online privacy policy. This is a legally binding agreement between you and the Tribune-Review Publishing Co. (the "Company"), so please read it thoroughly and carefully.

YourSewickley.com (the "Site") is intended to create an online community meeting place and forum that allows register members to share information in various forms about Sewickley, Aleppo, Bell Acres, Edgeworth, Glenfield, Haysville, Leet, Leetsdale, Osborne, Sewickley Heights, Sewickley Hills, and nearby communities.

1. Copyright on materials contributed by YourSewickley.com members is held by the individual creators. Except for personal use only, you may not reproduce, republish or redistribute content from this site in any form without permission from YourSewickley.com or the original copyright holder.

All postings, messages, text, files, images, graphics, photos, audio clips, sounds, video or other materials (the "Content") posted on, transmitted through, or linked from the Site, are the sole responsibility of the person from whom such Content originated. You are entirely responsible for all Content that you post, email or otherwise make available through the Site.

By posting content to the Site, you represent and agree that (1) you are the owner of the content, or otherwise have the right to post such content to the Site, (2) the content is accurate, true and complete and does not otherwise violate this agreement (3) the content will not violate the rights of or cause injury to any person or entity, and (4) you will indemnify the Company for any claims resulting from content that you submit to the Site.

By posting Content to the Site, you grant the Company, its affiliates and related entities a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, publicly perform, distribute, display, and create derivative works based on such content throughout the world in any media, and to incorporate such content into other works in any format or medium now known or later developed, for any purpose.

2. YourSewickley.com cannot monitor or control Content posted by members, nor is it responsible for Content posted or transmitted to the Site. In addition, the Company is not responsible for Content made available through the site by members. None of the messages posted on this web site are authored by the Company or any of its employees or agents unless the message expressly so states.

By using the site, you may be exposed to offensive, indecent, inaccurate, misleading, or otherwise objectionable material. Use good judgment and common sense when considering information available on the Site. You agree that you must evaluate information on the site and bear the risks associated with the use of that information. You understand that the Company does not screen content, however, it does have the right (but not the obligation) to refuse, delete or move any Content for violating the letter or spirit of this agreement or any other reason. The Company reserves the right to remove any Content for any reason, or for no reason.

3. Under no circumstances will the Company or its sponsors, affiliates, employees, directors or officers be responsible for any damages of any kind or nature resulting from your use of the Site, including without limitation harm to person, property or business interests, or incidental, consequential or special damages, or attorneys fees, and you agree to indemnify and hold Tribune-Review harmless from any and all claims arising out of your use of the Site.

4. Proper behavior will help make YourSewickley.com more successful and useful for its members. Therefore, you agree not to post, e-mail or otherwise make available through the site Content:

• that is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, libelous, or invasive of another's privacy, or harms minors in any way;
• that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
• that purports to be from any person or entity, including but not limited to a Provider employee, or falsely states or otherwise misrepresents your affiliation with a person or entity;
• that includes personal or identifying information about another person without that person's explicit consent;
• that is false, deceptive, misleading, deceitful, mis-informative, or constitutes "bait and switch";
• that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
• that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
• that constitutes or contains any form of advertising or solicitation if (1) posted in areas which are not designated for such purposes; or (2) emailed to YourSewickley.com users who have requested not to be contacted about other services, products or commercial interests;
• that advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by Pennsylvania law;
• that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Site, or that otherwise negatively affects other users' ability to use the Site; or
• that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Site.
• events that are not in the coverage area of this local Web site as deemed appropriate by the Company

Additionally, you agree not to:

• contact anyone who has asked not to be contacted;
• "stalk" or otherwise harass anyone;
• collect personal data about other users for commercial or unlawful purposes;
• use automated means, including scripts, spiders, robots, crawlers, data mining tools, or the like to download data from or upload data to the Site;
• post irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;
• attempt to gain unauthorized access to the Company's computer systems or any other user's computer systems, or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Site.

Users may report content they believe to be inappropriate or other violations of these terms by using the "Feedback" link at the bottom of any page on the Site.

5. To post information or comments on the YourSewickley.com, or to obtain access to certain Site services, you must become a registered member of the Site. In our registration process, you will be required to provide your name, e-mail address, zip code and age. You also will be asked to select a member name and a password. You agree that the information you supply during the YourSewickley.com registration process, and maintain after registration, will be accurate and complete and that you will not supply the e-mail address of, register under the name of, or attempt to access the site under the name of, another person. We will delete any member account that we believe has been created using false or fraudulent information, and will delete any content posted on the site using such an account.

The Company reserves the right to reject or terminate the use of any member name that we deem offensive or inappropriate. You are responsible for maintaining the confidentiality of your YourSewickley.com password and account, and are responsible for all activities that occur under your password and account. If you discover or suspect any unauthorized use of your password or account, or any other breach of security, you agree to immediately notify YourSewickley.com. We may terminate any member account that is inactive for an extended period of time.

6. We are concerned about the safety and privacy of children and, therefore, we do not permit children under the age of 13 to register to use the Service.

7. We reserve the right to terminate the member account of, and to restrict or deny access to our Site or any service provided via our Site to, anyone who violates this Community Agreement or who, in our judgment, interferes with the ability of others to enjoy this Site, or infringes the rights of others.

Commercial posts

8. The Site offers private individuals the opportunity to post forums or blogs that are commercial in nature. Placement of commercial posts is governed by this Community Agreement, including the following specific terms:

You represent and warrant that no commercial posts on the Site (1) will violate any applicable law, rule or regulation (including, but not limited to, any law relating to false or deceptive advertising), (2) will be libelous, nor (3) will it infringe any right of any third party, including, but not limited to, any contractual right, copyright, trademark or trade secret right or any right of privacy or publicity. You will indemnify and hold the Company, its affiliated entities and its employees harmless against any and all expenses and losses of any kind (including reasonable attorneys' fees) incurred by them in connection with (4) any breach or alleged breach of this warranty.

Additionally, posts that are commercial in nature are subject to the following:

• Are to be limited to one per week per business
• Consecutive posts cannot contain duplicate text or information. Such duplicate posts will be considered spam and removed.
• Commercial posts are strictly limited to local businesses within the coverage area of the Site. Regional or national businesses may purchase advertising.
• Commercial posts may be removed from the front page of the Site at the discretion of the Site staff. Any posts that are re-submitted in order to remain on the front page will be removed.

The following commercial posts are strictly prohibited:

• Posts promoting pyramid schemes, club memberships, affiliate recruitment business, or other home-based business opportunity which requires an up front or periodic payment, requires recruitment of other members, sub-distributors or sub-agents, or involves primarily commission based sales.
• Posts that promote or are set up to recruit members for home based businesses and or MLMs.

The aggregate liability of the Company arising out of any commercial information you attempt to post on the Site will be limited to the amount you paid to the Company, if any, with respect to the ad(s) and/or listings out of which the claim arises or the display of the relevant ad or listing at a later time, at the Company's discretion. Otherwise, the Company will not be liable to you for any loss, damage, or expense caused by or arising out of the Company's failure to display any blog or forum posting, or the manner in which any such ad or listing is displayed.

9. This agreement may be terminated by either party at any time. Section 3 of this agreement, and any rights granted to the Company under Section 1 of this agreement, will survive any such termination. In addition, the Company reserves the right to alter or modify this agreement from time to time by posting such changes here. By continuing to access the Site, you agree to be bound by the subscription and user agreement as modified from time to time. Furthermore, the Company reserves the right to alter or modify any aspect of the content of YourSewickley.com, in its sole discretion.

Privacy Policy

Protecting consumer privacy online is important to us. By taking steps to protect the privacy of our members, we also hope to increase members' confidence in the site and as a result, increase their online activity.

The purpose of this policy is to describe the types of information that may be collected, how the Company may use the information and whether it will be disclosed to anyone.

First, there will appear on the Site links to other sites that are not controlled by the Company. The Company has no control over the privacy policies or the content of business partners, advertisers or other sites to which this Site may provide links. You should check the privacy policies of other sites when linking to them.

By collecting certain types of information, the Company and YourSewickley.com hope to provide an improved interactive and personalized experience with the Site. We may use Personally Identifiable Information (name, e-mail address, street address, telephone number and other information) subject to the terms of this agreement. The policy applies only to information collected online through the use of YourSewickley.com and related community sites published by the Company. It does not apply to information collected by the Company or its affiliates by other means.

How we collect information depends on the pages you are visiting on the site and the activities in which users elect to participate. Many pages on the site may be accessed without registering. Other pages may prompt you for information, such as during the registration process or when users request certain features or make a purchase.

As most web sites do, YourSewickley.com also collects information automatically through the use of electronic tools that may not be seen by visitors. For example, the Site may log the name of your Internet Service Provider or use "cookie" technology. The cookie may store your username and password, eliminating the need to re-enter that information each time you visit the Site. Cookies may also allow us to control the number of times visitors view certain advertisements and may also allow us to deliver certain kinds of advertisements based on the content of pages visitors have previously visited. As additional technology becomes available, we may also collect information by other means. Users can choose to stop the collection of "cookie" information, for example, by setting a browser to refuse to accept cookies, but doing so may interfere with the functionality of the site.

We will use your information only as permitted by law. Aggregated information, which does not indentify personally identify users, may be used many ways. For example, we may combine information to determine which pages and which features on the Site are visited most often. Aggregated information may occasionally be shared with advertisers or others, but it cannot be used to identify or contact individuals.

The Personally Identifiable Information collected on the Site may be used to communicate with you about something you have posted, the community agreement or privacy policy, products or services offered by YourSewickley.com or the Company, administration of contests, processing e-commerce transactions or other topics the Company believes you may find interesting. Personally Identifiable Information collected on the Site may also be used for other purposes, including, but not limited to, trouble-shooting and site administration. Certain third parties, our e-mail service provider, for example, may access the information.

At some point, the Company may merge with buy, sell or partner with other companies or businesses, and user information may be among transferred assets. The Company may also disclose your information in response to a court order, at other times when the Company believes it is reasonably required to do so, in connection with the collection of amounts you owe to the Company, or if we deem it appropriate to give your information to law enforcement authorities. The company is not obligated to give users notice prior to disclosure of information.

The Company expects its partners, advertisers and third-party providers to respect the privacy of the Site's users. However, third parties and other content providers accessible through the Site, may have their own privacy and data collection practices. The Company is not responsible for the actions and practices of third parties. You should check the applicable policies of those third parties when providing information on a page provided by a third party.

While on the Site, our advertisers, partners and other third partners may use cookies or other technology in an attempt to collect information about you. For example, some of our advertising may be served by third parties and may include cookies that enable the advertiser to determine whether you have seen a particular advertisement before. Through features available on the Site, third parties may use cookies or other technology to gather information. The Company does not control the use of this information.

The Company urges you to be cautious and responsible whenever you are online. Should you choose to voluntarily disclose Personally Identifiable Information in public areas on the Site, such as in discussion boards, chat areas, blog entries, advertising or notices you post, that information can be viewed publicly and can be collected and used by third parties without our knowledge and may result in unsolicited messages from other individuals or third parties. Those activities are beyond the control of the Company and beyond the scope of this policy.
